Maine overview
Maine's Office of Aging and Disability Services (OADS) administers Medicaid home and community-based waiver services through Section 21 (community support) and Section 29 (older adults). Apply through OADS — Maine's waitlists are among the longer ones in New England. For early intervention (under 3), contact Child Development Services. The Maine Parent Federation (MPF) is the state's PTI center. Maine's rural geography means provider access outside Portland and Bangor can be limited — telehealth has expanded some options.

Maine is mid-transition. Ask about the Lifespan waiver rather than Section 21 or 29, since those are closing to new enrollment. Enroll in MaineCare first — it is the precondition.

- Age 10 and under. Maine has one of the lowest age ceilings in the country, and the entry is blunt about it because a family planning around Maine's mandate needs to know the cliff arrives early.
- Limits:
- A plan may limit ABA to $36,000 a year. No lifetime cap appears in the current text.
Self-funded employer plans (ERISA) are typically exempt — ask your HR department which type of plan you have.

Maine is unusually explicit — the benefit is written for members with intellectual disabilities or autism spectrum disorder, so autism is a named qualifying condition rather than something reached through general developmental disability language.

How the waiting list is ordered
Maine is in the middle of a structural change, and reading last year's guidance will send you to the wrong program. The Section 29 waiting list has ended, and both Section 21 and Section 29 are closing to new enrollment as the state moves to a single Lifespan waiver. OADS expects that within five years there will be no significant waitlists for the waivers serving people with intellectual disabilities, autism or related conditions. So the right question to ask on the phone is not "where am I on the Section 21 list" but "how does Lifespan enrollment work and what do I do now". Whatever the program is called by the time you apply, MaineCare enrollment plus medical eligibility remains the precondition, so get that done regardless.
How to apply
Enroll in MaineCare at mymaineconnection.gov or on 1-855-797-4357, and establish medical eligibility. Call Maine DHHS on 1-800-262-2232 for your regional OADS contact. A case manager can help with both applications — ask for one early rather than doing it alone.

ABA covered: Under 21MaineCare delivers ABA through Specialized Rehabilitative and Community Support Services (MaineCare Benefits Manual Section 28) for children and youth up to age 21 with an autism spectrum disorder diagnosis. Section 28 services must be authorized by the Department's authorized agent and are reviewed periodically for medical necessity. Call MaineCare Member Services at (800) 977-6740 with questions about covered services.
