No dollar maximum in the statute. Nebraska limits HOURS instead — behavioral health treatment including ABA carries a maximum of 25 hours a week until 21. Dollar limits, deductibles, copayments and coinsurance may be no less favorable than those applied to a general physical illness.

Self-funded employer plans (ERISA) are typically exempt — ask your HR department which type of plan you have.

How the waiting list is ordered

Nebraska eliminated its developmental disabilities registry outright in June 2025 — announced by the Governor's office, not merely trimmed or reduced. There is no queue. That makes the usual advice actively wrong here: do not rush an application in order to bank a place, because there is no place to bank and no seniority to accrue. The gate is eligibility instead, and specifically Medicaid, because a person must have Medicaid to receive these services. So the first practical step in Nebraska is not the waiver application at all — it is making sure Medicaid eligibility is established, through the ordinary route or through one of the disabled children's programs if household income would otherwise disqualify you.

Heritage Health members choose one of three statewide health plans and can switch during open enrollment, October 15 through December 7. Nebraska Medicaid's ABA service definition admits ages 0 to 20, and the assessment and treatment plan must be submitted with the initial prior authorization request.
