Delaware overview
Delaware's Division of Developmental Disabilities Services (DDDS) administers the Lifespan Waiver for adults and the Pathways to Employment waiver. Apply through DDDS early — the adult waiver has a waitlist. For children, Early Intervention is through DHSS Birth to Three. The Parent Information Center of Delaware (PTI) offers free IEP and special education support. The Autism Delaware organization provides direct family services, camps, social programs, and advocacy specific to Delaware families.

Contact the DDDS intake unit and request a Lifespan Waiver intake. Autism is named in the eligibility criteria, but the test is substantial functional impairment — the diagnosis alone is not enough.
Delaware is one of the few states with no waiting list at all.

- $36,000 per 12-month period for ABA — but that is the 2012 figure and it does NOT stay there. The Insurance Commissioner must publish a CPI adjustment in the Delaware Register of Regulations by 1 April each year, and the adjusted figure applies to policies issued or renewed after it. Ask for the current year's number. Two protections sit alongside it: there is no limit on the number of visits, regardless of where services are delivered, and payments for treatment unrelated to ABA do not count toward the ABA maximum.
Self-funded employer plans (ERISA) are typically exempt — ask your HR department which type of plan you have.

DDDS Lifespan Waiver

Delawareans found eligible for DDDS services with a diagnosis of intellectual developmental disability, autism spectrum disorder or Prader-Willi syndrome assigned during the developmental period.
How autism qualifies
Autism spectrum disorder is named directly in the eligibility criteria, which is better than most states. But read the second half carefully: eligibility rests on substantial functional impairment, not on the diagnosis alone. A diagnosis gets you considered; documented functional impact is what gets you in. Gather evidence of what daily life actually requires — support with self-care, communication, safety, routine — rather than relying on the diagnostic report to speak for itself.
Age rules
The qualifying condition must have been assigned during the developmental period. Three services added in 2026 are for people aged 12 and over.

How the waiting list is ordered
Delaware has no waiting list, which puts it in a very small group nationally. The gates are eligibility and money instead. On money, community-based long-term care applicants must have income at or below 250 percent of the SSI standard benefit rate and less than $2,000 in resources — a real constraint that families should check early rather than after months of paperwork, and one where a special needs trust or an ABLE account may be relevant to how resources are counted. On eligibility, the functional impairment standard is the substantive test. Delaware also expanded the waiver in 2026, adding Enhanced Behavioral Residential Services, Crisis Stabilization Services and Remote Supports with CMS approval on 1 July 2026, aimed at helping people aged 12 and over live more independently — worth asking about, since new services are the ones least likely to be mentioned to you.

Contact the DDDS intake unit at the Department of Health and Social Services and request a Lifespan Waiver intake. Prepare documentation of functional impairment, not just the diagnosis, and check the income and resource limits before you go far.

ABA covered: Under 21Federal Medicaid rules (EPSDT) require medically necessary treatment, including ABA, for enrollees under 21 in every state. We did not find Delaware publishing its own ABA policy, so ask your plan what it covers beyond that.

Delaware Medicaid members choose one of three managed care plans; if you don't choose in the time allowed (usually within 90 days), the Health Benefits Manager assigns one. Prescriptions and non-emergency transportation are covered directly by Medicaid rather than by your plan, and people on Medicaid home and community-based waivers are not enrolled in a plan.
